FMCSA DataQs & PSP Record Preparation Desk · US Commercial Drivers & Motor Carriers

Dismissed or wrong DOT violations stay on your federal PSP record until you file a Request for Data Review.

When a county or municipal court dismisses or reduces a traffic ticket, the court never notifies the FMCSA. The original roadside inspection violation stays on your Pre-Employment Screening Program (PSP) report for 3 years—and hits the carrier’s CSA score for 2 years—until a properly documented Request for Data Review (RDR) is submitted through FMCSA DataQs.

We audit your inspection report and court or maintenance records, draft a regulation-cited Request for Data Review brief mapped to the FMCSA DataQs Analyst Guide, format your exhibits, and deliver a ready-to-file packet within 24 hours.

Citation Dismissed or Found Not Guilty in Court

County and municipal courts do not automatically notify FMCSA when a traffic ticket is dismissed. Under FMCSA’s Adjudicated Citation rule (for inspections on or after Aug 23, 2014), once you submit an Adjudicated Citation RDR with the certified court disposition, the state agency must remove the roadside violation from MCMIS, your 3-year PSP report, and the carrier’s CSA score.

Required DataQs RDR Path: Citation -> Adjudicated Citation (Dismissed without fine / Not Guilty)
Controlling Federal Rule: FMCSA Policy on Adjudicated Citations (79 FR 32491; DataQs Analyst Guide § 4.3)
Mandated Record Outcome: Mandatory complete removal of the linked violation from both PSP and Carrier SMS.

Evidence Exhibits Required for State Review:

  • Roadside Inspection Report (Form MCS-63) or Inspection Number + State + Date
  • Certified Court Disposition, Docket Sheet, or Judge’s Dismissal Order showing dismissed without fine / not guilty

Why Self-Filed DataQs Get Denied — And What Our Prepared Packet Looks Like

State commercial vehicle enforcement analysts process hundreds of DataQs submissions a week. Emotional explanations get closed in minutes. Structured briefs citing the exact 49 CFR section, MCMIS inspection identifier, and FMCSA Analyst Guide mandate get approved.

TYPICAL DRIVER SELF-SUBMISSION (DENIED)

RDR Type Selected: "Other / General Complaint"

"I went to court in Texas and paid my lawyer and the judge dismissed this speeding ticket. Why is it still on my PSP report? I just lost a job offer with a fuel hauler because of this. The trooper wrote 392.2S on the inspection sheet even though it was thrown out. Please take this off my record ASAP."
State Analyst Response (Closed — No Data Correction):

Filed under wrong RDR category; did not attach certified court docket matching the citation number listed on Form MCS-63; did not cite FMCSA Adjudicated Citation Policy (79 FR 32491).

RDR CATEGORY: Citation → Adjudicated Citation (Dismissed Without Fine)
MCMIS REPORT #: TX6841029384 · DATE: 04/14/2026 · STATE: TX
CITED VIOLATION: 49 CFR § 392.2-S (Speeding 11–14 mph over limit)

1. REGULATORY MANDATE (79 FR 32491 / DATAQS ANALYST GUIDE § 4.3): Pursuant to FMCSA’s Policy on Adjudicated Citations (effective August 23, 2014), when a roadside inspection violation is associated with a state or local citation that is subsequently adjudicated as "dismissed without fine" or "not guilty," the State agency must update MCMIS to remove the violation from the driver’s Pre-Employment Screening Program (PSP) record and the motor carrier’s Safety Measurement System (SMS) profile.

2. EVIDENTIARY RECORD CROSS-REFERENCE: Form MCS-63 Report #TX6841029384 lists Citation #2026-TR-088412 alongside Violation Code 392.2-S. As shown in Exhibit A (Certified Disposition, Precinct 2 Justice Court, Cause #2026-TR-088412, signed 06/02/2026), said citation was dismissed in its entirety without fine, court cost, or probation.

3. REQUESTED MCMIS ACTION: Delete Violation 392.2-S from Inspection Report #TX6841029384 in State SAFETYNET/MCMIS so that the removal propagates to FMCSA PSP and SMS.

Frequently Asked Questions

Why is a dismissed traffic ticket still showing up on my PSP report?

Because a traffic citation and a DOT roadside inspection report (Form MCS-63) live in two completely separate databases. When a judge dismisses your citation in county or municipal court, the state DMV may update your MVR, but the court never notifies the FMCSA’s MCMIS database. Only an Adjudicated Citation Request for Data Review (RDR) filed through FMCSA DataQs with the certified court disposition removes the violation from your PSP and the carrier’s CSA score.

What if my ticket was reduced or amended instead of fully dismissed?

Under FMCSA’s Adjudicated Citation policy (79 FR 32491), if a citation associated with a roadside inspection violation is reduced or amended to a different charge in court, the state agency must update the inspection record to match the adjudicated charge. In many cases, reducing a severe moving violation (such as reckless driving or 15+ mph speeding) to a lesser or non-reportable equipment offense drastically cuts or eliminates the violation points.

Will filing a DataQs challenge notify or hurt my current employer?

Individual CDL drivers have an independent right under federal regulation to challenge inaccurate data on their personal PSP history. Better yet, when a violation is removed or downgraded via DataQs, the points are simultaneously removed from the motor carrier’s SMS / CSA BASIC percentile—helping both you and the carrier.

How long does the state agency take to decide a DataQs request?

Under FMCSA’s updated federal DataQs rules effective September 18, 2026, state agencies must issue an Initial Review determination within 21 calendar days. If additional information is requested, you have 14 days to respond. If an initial request is denied, you have 30 days to request Reconsideration (decided by a multidisciplinary panel within 21 days) and Final Review (45 days).

Can I challenge a roadside warning where no court ticket was issued?

Yes—not through the Adjudicated Citation path, but through an Inspection / Violation Listed in Error RDR. Because warnings cannot be contested in traffic court, your DataQs challenge must prove that the officer misapplied the 49 CFR regulation code or CVSA criteria using objective contemporaneous evidence (such as unedited ELD data, a valid National Registry medical certificate, pre-trip DVIRs, or timestamped repair orders).

Does FMCSA charge a government fee to file a DataQ?

No. FMCSA provides the DataQs portal (`dataqs.fmcsa.dot.gov`) at $0 government fee. ClearPSP charges a flat compliance preparation fee ($59–$179) to audit your documents, identify the controlling 49 CFR and DataQs Analyst Guide rules, draft your formal RDR brief, format your exhibits, and guide your submission through completion.
